SPANISH LAW AND OWNERS WHO WILL NOT PAY FEES

WHY IS IT THAT APPROX 25% OF OWNERS AT SITIO CAN GET AWAY WITH NOT PAYING COMMUNITY FEES. THESE ********* SPOIL IT FOR THE OWNERS WHO DO PAY. WHAT WOULD HAPPEN IF WE ALL TOOK THIS STANCE OF NOT PAYING ???.
UNFORTUNATELY, HUMAN NATURE BEING AS IT IS, THE LONGER PEOPLE GET AWAY WITH NOT PAYING, THE MORE PEOPLE WILL JUMP ON THE BAND WAGON AND DECIDE NOT TO PAY. I HAVE HEARD THIS FIRST HAND FROM A COUPLE OF OWNERS. IF THIS WAS TO HAPPEN IT WOULDNT TAKE LONG FOR SITIO TO GO DOWN THE PAN AND BECOME VERY UNDESIREABLE. IF ANYONE WHO HASNT PAID READS THIS, PLEASE GET A CONCIENCE AND PAY UP BEFORE YOU RUIN THINGS FOR OTHERS.
WHY IS SPANISH LAW SO POOR THAT WE CANNOT ENFORCE SOME SORT OF NOTICE ON OWNERS WHO DO NOT PAY. MAYBE I AM BEING TOO SIMPLISTIC REGARDING DEBTORS BUT WHY NOT CUT OFF THEIR WATER SUPPLY AND PUT HUGE PADLOCKS ON THEIR DOORS UNTIL THEY PAY UP. MAYBE LARGE SIGNS ON THEIR APARTMENTS AS WELL.
I KNOW THIS IS OVER THE TOP BUT SOMETHING HAS TO HAPPEN BEFORE ITS TOO LATE.
NO DOUBT I AM NOW LEAVING MYSELF OPEN FOR A BARRAGE OF ABUSE.

Dont worry about abuse Gary - this 'independant ' forum was set up by Ken and I for the purpose of letting everyone - owners, resdidents and visitors to express their own ideas. views and information. Abuse will not be allowed but constructive ideas and fair critisicism is nothing to be feared. By all means make your points - our only request is that there are no 'personal' attacks.

Again Gary, I have to say, as someone who is struggling every month to pay his community fees, it is easy to come up with a 'one solution fits all' like chaining up my property, cutting off my water supply etc. Although I am a debtor, I pay 100€ per month on standing order to the administrator. If I was 'cut off' the community would lose that income, the apartment would eventually be repossessed by the bank (about a year later) and then put on the market - and we all know how quickly Sitio apartments are selling these days!!! So solutions such as these are in the end counter productive.

The way forward is for a much more pro-active approach by the committee with regard to collection of fees. Every debtor should be spoken to directly by a committee member in order to try to find a suitable solution in each case. Threats of court action etc should be a last resort because it takes years for such action to be successful, if ever.
